Tashkent, Uzbekistan (UzDaily.com) - At the fourth plenary session of the Senate, the Law of the Republic of Uzbekistan “On Amendments and Additions to Some Legislative Acts of the Republic of Uzbekistan in Connection with the Increasing Responsibility for Illegal Seizure of Land” was also considered.

The law makes amendments and additions to the Criminal Code, the Code of Criminal Procedure of the Republic of Uzbekistan and the Code of the Republic of Uzbekistan on administrative responsibility.

The Criminal Code is supplemented by Article 1731 (Unlawful Seizure of the Land), consisting of five parts. According to the first part of this article, unlawful seizure of a land plot committed after applying an administrative penalty for the same actions shall be punishable by a fine from two hundred to two hundred and fifty basic calculation units or by obligatory community service from three hundred to three hundred and sixty hours, or by corrective labor up to two years.

Part two of this article indicates aggravating circumstances of Illegal seizure of a land plot, which entailed the demolition of buildings, other structures, structures or plantings or their parts on a seized land plot, without preliminary and full compensation for losses at the market value of the said property, committed after applying an administrative penalty for the same actions or causing significant damage, shall be punishable by deprivation of liberty for up to three years with the deprivation of a certain right.

Part three of this article provides that the same actions committed with causing serious damage are punishable by imprisonment from three to five years, and according to part four of this article the same actions committed with a generally dangerous method or with causing especially serious damage are punished by imprisonment from five to eight years with a deprivation of a certain right.

The adoption of the Law will serve to ensure guarantees of property rights and legitimate interests of citizens and business entities by strengthening responsibility for non-compliance with the procedure for withdrawing a land plot and causing damage to owners.
