Uzbek leader signs decree on protection of private property

Tashkent, Uzbekistan (UzDaily.com) -- President of Uzbekistan Islam Karimov signed a decree “On measures on ensuring reliable protection of private property, small business and private entrepreneurship, eliminating barriers for their fast development” on 15 May 2015.
The document was adopted to improve role and place of private property in economy, liquidate barriers on the way of development of small and private businesses, decrease state presence in economy, etc.
With his decree, the Uzbek leader approved a programme of measures on ensuring reliable protection of private property, small business and private entrepreneurship, eliminating barriers for their development.
The programme is directed at raising responsibility of officials of state, controlling and law enforcement bodies for illegal interference to activities of private businesses.
It also envisages strengthening guarantees for protection of private property, liberalize administrative and criminal legislations, regulating business activities.
It is planned to simplify registration, permission and licensing procedures for foreign economic activities for businesses, etc.
The document said that planned inspection of microfirms, small enterprises and farms by the controlling bodies will be conducted once four years and other business entities – once in three years and only with permission of the Republican Council on coordination of activities of controlling bodies of Uzbekistan.
The inspections, which are not related with financial-economic activities, should not exceed ten working days. The planned inspection of financial-economic activities of the businesses should cover only period after last planned inspection.
The inspections of law enforcement bodies on opened criminal cases can be conducted only with participation of lawyers, excluding cases when the business entities refuse to attract the lawyer.
The person, who evaded from payment of taxes and other mandatory payments for the first time and paid damage and fines within 30 days will be exempted from criminal charges and other responsibilities.
Uzbek leader entrusted the Prosecutor General’s Office to strengthen supervision on execution of laws on guarantees of freedom of entrepreneurship activities and attracting officials to responsibility, including criminal charges, for interference to activities of business entities and violation of their rights.
Prosecutor General’s Office should also launch 24-hour hotline to accept complaints from businesses on violation of their right and adopt corresponding measures to eliminate them.
Uzbek leader provided right to economic courts to suspend decisions of controlling bodies, appealed by the business entities, for the period of consideration of complaints.
Properties of businesses can be seized for violation of tax and customs legislation only in line with the decision of the court, the decree said.
The President also allowed individual entrepreneurs to hire from 1 to 3 employees based on their type of activities. At the same time, individual entrepreneurs should pay insurance fee to off-budget Pension Fund at the size of equal to 50% of minimum salary in Uzbekistan for each employee and the fixed tax at the size of 30% from set rate for individual entrepreneur.
He also exempted individual entrepreneurs from payment of fixed tax for employees, who graduated colleges within 12 months.
Islam Karimov also ordered to create one-stop-shop centers on the base of Inspections on registration of business entities under the city and district administrations.
One-stop-shop centers should be created by 1 January 2016. Uzbek leader banned other state bodies and economic entities to accept documents from businesses to render state services, provided by one-stop-shop centers.
