Tashkent, Uzbekistan (UzDaily.com) - On 26 February 2021, a meeting of the Kengash of the Senate of the Oliy Majlis of the Republic of Uzbekistan was held in the format of video conferencing. The meeting was chaired by Tanzila Narbaeva, Chairman of the upper house of parliament.
At the meeting, which was attended by members of the Senate, senior officials of the Cabinet of Ministers, the results of the study of the state of implementation of laws, law enforcement practice and monitoring carried out regarding the adoption of by-laws were discussed.
It was noted that in order to radically improve the quality of legislative activity, improve the legal support of ongoing reforms, the Senate committees studied the state of implementation of a number of laws, law enforcement practice and monitored the adoption of bylaws
The analysis showed that some laws do not reflect specific mechanisms, due to the presence of reference norms, the sphere is mainly regulated by bylaws, and it is also necessary to revise and improve the legislation in accordance with the requirements of today due to the fact that in practice the norms of the adopted individual laws do not apply.
In particular, the Law "On Electronic Commerce" does not systematize legislative acts in the field of electronic commerce, nor do they combine norms and relations that directly regulate these relations into a single law. The law also, along with national payment systems, does not reflect the rules on the use of international payment systems in the implementation of electronic commerce.
In addition, the Law "On Charity" does not define norms for the protection of the rights and interests of charitable organizations and the coordination of their activities. Mechanisms for providing incentives and incentives to business entities and NGOs carrying out charitable activities have not been introduced that meet modern requirements. The possibility of obtaining open and reliable information about the activities of individuals and legal entities engaged in individual charitable activities and the spending of funds allocated to them has not been created.
Due to the fact that the Law "On guarantees and freedom of access to information" does not specifically define in what cases restrictions are imposed on the provision of information, there are also cases of failure by the owner of the necessary information under the pretext that the information belongs to state secrets. The norms have not been established regarding the appeal of illegal restrictions on the right to receive information, a special state body for the consideration of complaints and its competence.
The meeting noted the expediency of involving the public in the process of developing laws, as well as to prevent misunderstandings, to carry out explanatory work.
In addition, during the meeting, the focus was on the implementation of the resolution of the Kengash of the Senate of the Oliy Majlis of the Republic of Uzbekistan from 25 August 2020 No. PC-119-IV "On the issues of improving the legislation of the socio-economic sphere, based on the problems that arose during the coronavirus pandemic."
It was noted that a certain amount of work had been done to ensure the implementation of the Action Plan to improve the legislation of the Republic of Uzbekistan on the socio-economic sphere, approved by this resolution of the Kengash of the Senate.
Thus, 5 legislative acts were adopted on the mechanisms for the formation of local budgets, the activities of private employment agencies, state policy in the field of providing social assistance to the population, improving legislation on pensions, introducing the institution of dual education in the activities of higher educational institutions.
Five decrees and resolutions of the President of the Republic of Uzbekistan were adopted aimed at introducing a procedure for subsidizing and restructuring loans allocated for entrepreneurship in emergency situations, the practice of selling "ready-made business" projects by commercial banks, modern mechanisms of state support for entrepreneurial activity in a pandemic, the development of our countries of innovation, improving the regulatory framework in the field of migration.
In addition, 6 drafts of regulatory legal acts were developed aimed at improving the activities of limited and additional liability companies, strengthening the social protection of orphans and children left without parental care or other legal representatives, introducing distance and other modern forms of education into the education sector. , development of the preschool education system in the context of a pandemic, improvement of the quality of medical and sanitary care provided to the population, its development in accordance with the requirements of the time.
However, the senators noted that along with the work done, there are some shortcomings in ensuring the implementation of the action plan.
So, the implementation of such tasks as the development of types of remote services in the provision of financial and banking services and the creation of their legislative framework, the electronic registration of civil law relations in the sale of goods and the provision of services, the conclusion of electronic contracts, the introduction of an outsourcing system into banking activities. In addition, in the context of a pandemic, the tasks of improving the Labor Code, introducing a system of off-budget corporate social insurance in order to ensure guarantees of women’s labor rights have not been fully implemented.
The meeting also considered the issue of measures to strengthen parliamentary control over the implementation of agreements on trade and economic cooperation reached during the high-level visits.
It was noted that, based on the priority areas and tasks identified by the President of the Republic of Uzbekistan in the field of economic development, as well as in order to ensure the effectiveness of the successive economic reforms carried out at the initiative of the head of our state, work is being carried out to strengthen parliamentary control.
Thus, the practice of regularly hearing information from the heads of diplomatic missions of the Republic of Uzbekistan abroad on the development of bilateral cooperation and responsible ministries and departments on the implementation of trade and economic agreements adopted following the results of high-level visits has been introduced.
In particular, the working group of the Senate studied the implementation of action plans ("road maps") for the implementation of investment projects and trade agreements signed during the official visits of the President of the Republic of Uzbekistan to Turkey and Japan. As a result, a number of shortcomings were identified.
In particular, out of 49 investment projects planned jointly with Turkey for US$608.3 million, 12 projects (US$107 million) were not completed on time, another 7 projects (US$223 million) were not implemented.
And of the planned 40 joint investment projects with Japan for a total of US$4 billion 393 million, the implementation of 19 projects for US$2 billion 577 million are behind the deadlines, 4 more projects for US$109 million have not been completed.
At the meeting, attention was focused on the fact that a number of systemic problems remain in the implementation of these projects. In particular, there is no system of strict control over the implementation of "road maps" for the implementation of documents signed during high-level visits.
In addition, the development (examination) of in-depth and comprehensive feasibility studies of investment projects, which must be signed during high-level visits, does not meet the requirements.
It was noted at the meeting that local senators and deputies of local Kengashes should monitor and be active in the implementation of investment projects in the regions and defined in the road maps, as well as in overcoming existing problems.
Also, ministries and departments were given instructions and instructions to eliminate existing problems and shortcomings.
On the issues considered at the meeting, the relevant resolutions of the Kengash of the Senate of the Oliy Majlis were adopted.
