Uzbekistan approves the Strategy for the Development of Competition in Commodity and Financial Markets for 2020-2024

Tashkent, Uzbekistan (UzDaily.com) -- The Presidential Decree “On Additional Measures to Further Develop the Competitive Environment and Reduce State Participation in the Economy” was adopted.
In accordance with the Decree, starting from 1 October 2020, in the following cases it is not allowed to create business entities with the participation of the state and their affiliates, as well as state institutions authorized to carry out business activities (except for the creation of defense and national security):
in areas in which five or more private business entities are already operating on the same product market;
on the part of government bodies in those areas in which they are authorized to license, register, accredit and issue permits.
The decree defines the legal acts that are adopted in the presence of the conclusion of the Ministry of Economic Development and Poverty Reduction, the Ministry of Justice, as well as the Antimonopoly Committee.
Also, the Strategy for the development of competition in the commodity and financial markets for 2020-2024 was approved.
According to the Decree, the Antimonopoly Committee is accountable to the Senate of the Oliy Majlis and the President in its activities.
Until 1 November 2020, a unified draft law will be developed by combining the laws “On Competition” and “On Natural Monopolies”.
In accordance with the Decree, starting from 1 January 2021, executors of public procurements, as well as purchases of business entities and enterprises of strategic importance, are required to:
within two days from the day of their official announcement as winners based on the results of tenders and tenders, selection of the best offers, as well as the results of direct negotiations, disclose information about their final beneficiaries (beneficiaries) who have actual control by directly or indirectly owning 25 or more percent of them shares (shares) by posting relevant information on a special public procurement information portal;
permanently post on its websites and a special information portal information on the status of fulfillment of obligations under agreements concluded as a result of tenders and tenders, the selection procedure for the best offers, as well as direct negotiations.
Starting from 1 January 2021, as an experiment, a system of internal organizational measures and procedures (antitrust compliance) has been introduced in government, local executive bodies, and also enterprises with state participation.
In the structure of the Committee, a Directorate has been established to monitor the provision of state aid and evaluate its effectiveness.
Also, a methodology for diagnosing a competitive environment in all sectors of the country’s economy will be developed based on the Product Market Regulation-PMR.
Until 1 March 2021, an electronic system will be developed to determine online the availability of private business entities in the commodity and financial markets, as well as affiliates involved in public procurement.
