Tashkent, Uzbekistan (UzDaily.com) -- At the twenty-first plenary meeting of the Senate of the Oliy Majlis of the third convocation, held in August 2019, a parliamentary inquiry was sent to the Cabinet of Ministers of the Republic of Uzbekistan on the state of horticultural and viticultural partnerships and issues of improving their organizational and legal framework.
The results of this parliamentary inquiry were considered today, on 20 November, at the ninth plenary session of the Senate.
It was noted that the parliamentary inquiry raised problems related to the conduct of a complete inventory of the activities of horticultural and viticultural associations, state registration of rights to land plots and structures, the return of illegally acquired and inefficiently used resources to the category of reserve lands in accordance with the law. At the plenary session, it was noted that the Cabinet of Ministers approved a plan of practical measures to resolve issues.
Also, a draft government resolution “On measures to further improve the mechanism for regulating the activities of horticultural associations” was developed, which in July-August 2020 was posted on the regulation.gov.uz portal for public discussion. The objectives of this draft are aimed at systematically addressing the issues raised in the parliamentary inquiry. However, until today this draft resolution has not been adopted.
Until the 80s of the last century, "garden and viticultural associations" were located in cities, created on the lands allocated to workers of large industrial enterprises, organizations and institutions who lived in multi-storey buildings for growing agricultural products.
However, in recent years these farms have practically not fulfilled this function. It was noted that today most of the country houses are not, as before, a place for carrying out sowing work on weekends, but have turned into places of year-round residence.
Also, many country houses, especially in the mountainous and foothill regions of the Tashkent region and other areas, are used for commercial purposes. If you ask the locals for the name, they answer that this is a country house, but in fact it is a hotel, teahouse, cafe and other similar consumer services.
In addition, according to the Ministry of Justice, today the procedure for admitting a gardening and viticultural partnership and exclusion from it is not followed. The number of corporate disputes related to partnership management has increased.
The Ministry of Justice of the Republic of Uzbekistan has raised serious objections in connection with the inconsistency with the legislation of the provisions on state registration of property rights to buildings and structures located on land plots allocated for garden and viticultural associations. In addition, it was noted that some points of the draft should be revised and the adoption of the draft document in the proposed version is not advisable, which shows the need for a thorough and serious study of this issue on site.
Based on the foregoing, in order to comprehensively study the activities of horticultural and viticultural associations, identify, eliminate problems that may arise and regulate this area, an order of the Cabinet of Ministers of the Republic of Uzbekistan No. 490-r from 13 November 2020 was adopted.
This order, in order to comprehensively study the activities of partnerships, approved a republican working group, an approximate composition of the working group of the Republic of Karakalpakstan, regions and the city of Tashkent and districts (cities).
In this regard, the plenary session emphasized the need to introduce open and transparent mechanisms for transferring structures built on the territory of gardening and viticulture associations to the category of a residential building. Attention is also drawn to the need to develop the activities of social facilities in the territories where such partnerships are located in proportion to the actual population size, as well as to strengthen measures to combat crime and systematically establish the prevention of offenses.
A corresponding resolution of the Senate of the Oliy Majlis was adopted on this issue.
