Tashkent, Uzbekistan (UzDaily.com) -- Uzbekistan introduced administrative and criminal responsibility for begging.
President of Uzbekistan Shavkat Mirziyoyev signed the law “On introducing amendments and addenda to some legislative acts of the Republic of Uzbekistan aimed at improving the mechanisms for ensuring public order” on 9 January.
The document was adopted by the Legislative Chamber of the Oliy Majlis on 30 November and approved by the Senate on 13 December.
According to the law, the begging is defined as “active begging for money, food and other material values at airports, train stations, parks, leisure parks, markets and shopping areas, as well as adjacent territories, temporary storage facilities for motor vehicles, streets, stadiums , stops, on the carriageway of roads, areas of location of objects of tangible cultural heritage, all types of public transport and other public places.”
According to article 188−3 of the Administrative Responsibility Code, engaging in begging entails the imposition of a fine in the amount of from 1 to 3 minimum wages or an administrative arrest of up to 15 days.
Involvement in begging of persons of minor, old age, persons with mental illness, persons with disabilities and other persons, as well as involvement in begging of persons with their compulsion to use alcoholic beverages or substances that are not narcotic or psychotropic, but affect intellectual-volitional activity a person is punishable by a fine of 5 to 10 sizes of the minimum wage or an administrative arrest of up to 15 days.
The criminal code is supplemented by article 127−1, according to which for engaging in begging after applying administrative penalties for it is punishable by compulsory community service up to 240 hours or correctional labor up to 2 years or restriction of liberty up to 1 year or imprisonment up to 1 year.
Involvement in begging of the above-mentioned persons after applying an administrative penalty for the same actions is punished with a fine of 100 to 200 sizes of minimal salary or compulsory community service for up to 360 hours or correctional labor for up to 2 years or restriction of liberty from 1 to 3 years or imprisonment up to 3 years.
Involvement in begging repeatedly or by a dangerous recidivist, by an organized group or in its interests, or by forcing another person to use narcotic drugs, their analogues or psychotropic substances is punished with imprisonment from 3 to 5 years.
